1. Acceptance of terms

By accessing this website or using applications maintained by MIDAS GROWTH LLC, a Wyoming limited liability company, you agree to these Terms of Service. If you do not agree, do not use the services.

2. Description of services

We provide internal-use applications for managing advertising campaigns on advertising platforms, including the Meta Platform APIs. These applications are not distributed to the public and offer no third-party registration.

3. Eligibility

Use is limited to authorized administrators of the ad accounts we manage, who must be at least 18 years of age.

4. Acceptable use

You may not:

• Use the services for unlawful or fraudulent purposes
• Attempt to gain unauthorized access to systems or accounts
• Interfere with the stability of the servers operated by Meta or third parties
• Distribute malware, spyware, or adware
• Engage in spam or deceptive communication
• Violate the Meta Platform Terms, the Meta Advertising Standards, or the Meta Community Standards

5. Meta Platform compliance

Our applications operate in accordance with the Meta Platform Policy. In particular, we commit to:

• Keeping our Business Manager account current (Section 3.4)
• Not adversely affecting the stability of Meta servers or other apps (Section 3.6)
• Using advertising data only as permitted by Section 10.7
• Not combining data obtained from Meta with advertising campaigns on other platforms
• Protecting access tokens and app secret keys, and not transferring them to third parties (Section 6.a.iv)

6. Intellectual property

All content and application code is owned by MIDAS GROWTH LLC or its licensors. No license is granted beyond authorized use.

Meta, Facebook, and Instagram are trademarks of Meta Platforms, Inc. This website is not affiliated with, sponsored by, or endorsed by Meta Platforms, Inc.

7. Privacy

Our handling of data is governed by the Privacy Policy, which forms part of these Terms.

8. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, nor any particular advertising result.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIDAS GROWTH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. Some jurisdictions do not allow certain limitations, so these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless MIDAS GROWTH LLC and its members from any claim arising out of your violation of these Terms or of applicable law.

11. Suspension and termination

We may suspend or terminate access for violation of these Terms, of Meta policies, or as required by law.

12. Changes to these Terms

We may modify these Terms. Material changes will be posted on this page with a new effective date. Continued use after posting constitutes acceptance.

13. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction.
